Article 01 Definitions
1. The assignment:
The assignment concerns the agreement between the traveler and Angling Escapes | De Vissende Hollander, whereby Angling Escapes commits to providing services to the traveler in the field of fishing and related travel, in the broadest sense of the word.
2. Angling Escapes | De Vissende Hollander:
The party who, in the exercise of their business, advises, informs and mediates in the conclusion of agreements in the field of travel.
3. Service provider:
The carrier, accommodation provider, Angling Escapes | De Vissende Hollander and/or other service providers in the field of travel, in the broadest sense of the word, with whom the traveler enters into an agreement and who, taking into account the applicable conditions, is responsible for the execution of the service.
4. Traveler:
a. The client (applicant), or
b. The person on whose behalf Angling Escapes | De Vissende Hollander has performed services which have been accepted by the client.
Article 02 The Assignment in General
The content of the assignment may include informing and advising the traveler, as well as reserving the services desired by them on behalf of the traveler where possible.
2. The client is bound to the agreement with Angling Escapes | De Vissende Hollander and service provider after providing the assignment, regardless of whether a confirmation is immediately provided. If a fee is owed for a service from De Vissende Hollander itself, Angling Escapes | De Vissende Hollander will make this known in advance.
3. The (assignment) confirmation can generally be sent to the client within seven working days, in which case this confirmation serves as proof of the agreement described in the confirmation.
4. The client has the opportunity to submit a written objection within three working days after receiving the assignment confirmation, if they believe that the agreement is not correctly represented on the confirmation. In the absence thereof, the confirmation serves as proof of the existence and content of the agreement. This does not affect the possibility for the client to provide counter-evidence. Even in the case where the assignment confirmation is sent later than mentioned by De Vissende Hollander, the client can submit a written objection within three working days after receipt.
5. The client is fully liable both to Angling Escapes | De Vissende Hollander and to the service provider for the obligations arising from the services provided by Angling Escapes | De Vissende Hollander. The other travelers are liable for their part.
Article 03 The Reservation Assignment
1. The client will provide the data concerning themselves and the (possible) other traveler(s) required for concluding the agreement and its execution to De Vissende Hollander in consultation.
2. The prices of reserved services may be changed in accordance with the conditions of Angling Escapes | De Vissende Hollander. These changes will be communicated as soon as possible and will be charged accordingly.
3. Any cancellations of, or changes to, the provided assignment(s) can only take place on working days and only at the request of the client. If a cancellation takes place at the request of the client, or changes are made to the already made reservations, the associated costs will be charged. These may include, in addition to the cancellation or change costs charged by the service provider, the costs that Angling Escapes | De Vissende Hollander must incur to bring about the cancellation or change.
4. All communications from Angling Escapes | De Vissende Hollander or service provider will be directed exclusively to the client.
Article 04 Payments
1. The amounts owed must be paid to Angling Escapes | De Vissende Hollander within the period indicated by Angling Escapes | De Vissende Hollander. De Vissende Hollander is authorized to collect the amounts owed in the name and on behalf of the relevant service provider(s) if necessary.
2. De Vissende Hollander will require a down payment equal to 50% of the total agreed travel sum when providing the assignment(s) (unless otherwise agreed).
3. The remainder of the amount owed must be received by Angling Escapes | De Vissende Hollander no later than the date mentioned in the confirmation or invoice. In case of any discrepancies between confirmation and invoice, the confirmation applies.
4. If payment is not made or not made on time, the traveler is in default, Angling Escapes | De Vissende Hollander then has the right to charge the costs as referred to in article 3.3 or to offset them against the received down payment(s).
5. Any refunds are made exclusively to the client.
Article 05 Liability
1. Angling Escapes | De Vissende Hollander will exercise the care of a good contractor in their work.
2. If Angling Escapes | De Vissende Hollander provides services (including advice/information) that lead to the conclusion of a package travel agreement to which the conditions apply, only these conditions apply, also insofar as it concerns the liability of Angling Escapes | De Vissende Hollander. The responsibility for handling complaints about the services provided by Angling Escapes | De Vissende Hollander rests in that case with Angling Escapes | De Vissende Hollander.
3. The conditions also apply if Angling Escapes | De Vissende Hollander must be regarded as Angling Escapes | De Vissende Hollander under Dutch law, for example if they sell a package tour from a foreign provider.
4. Without prejudice to the above, Angling Escapes | De Vissende Hollander accepts no liability for actions and/or omissions of the involved service provider(s), nor for the accuracy of the information provided by these service provider(s). Angling Escapes | De Vissende Hollander bears no responsibility for photos, brochures and other educational material, insofar as these have been published under the responsibility of third parties.
5. Insofar as De Vissende Hollander itself is imputably in default and the traveler suffers damage as a result (including damage due to loss of travel enjoyment), the liability is limited to a maximum of 25% of the invoiced services.
6. Liability for damage against which the traveler is insured (e.g., through travel and/or cancellation insurance or health insurance), as well as liability for damage that the traveler suffers in the context of practicing a profession or business (including damage from missing connections or not arriving at the destination on time), are excluded.
7. Angling Escapes | De Vissende Hollander is not responsible for any promises made by its staff and/or third parties, whereby there is a recognizable deviation from the conditions stated in these conditions or in the conditions of the responsible service provider, unless such promises are subsequently confirmed in writing.
8. The exclusions and limitations of liability included in this article also apply for the benefit of the staff of Angling Escapes | De Vissende Hollander and/or the third parties engaged by them.
Article 06 Documents
1. The traveler must ensure that they are in possession of the required documents upon departure, such as a valid passport, any required visas, proof of inoculations and vaccinations, as well as the necessary vouchers.
2. Angling Escapes | De Vissende Hollander will provide general information regarding passports, visas and any health formalities at the time of assignment.
3. The traveler will obtain the necessary additional information from the relevant authorities themselves and also check in time before departure whether this information is still correct.
Article 07 Interest and Collection Costs
1. The traveler who is in default owes the statutory interest unless the conditions of the relevant service provider prescribe a higher interest rate.
2. Furthermore, the traveler is obliged to compensate for extrajudicial costs incurred by Angling Escapes | De Vissende Hollander for the collection of the claim. This amount equals 15% of the claimed amount with a minimum of €60, unless this amount is unreasonable considering the collection activities.
Article 08 Disputes
1. Dutch law applies to all disputes between Angling Escapes | De Vissende Hollander and the traveler. Only a Dutch court has jurisdiction to hear these disputes.
2. Complaints about reservations.
Complaints about a reservation made by Angling Escapes | De Vissende Hollander can be submitted in writing to Angling Escapes | De Vissende Hollander up to three days after the end of the reserved service or, if the trip did not take place, up to one month after the original departure date stated in the travel documents.
3. Complaints about advice and information.
Complaints about advice and information provided by Angling Escapes | De Vissende Hollander must be submitted in writing and with reasons to Angling Escapes | De Vissende Hollander within one month after the traveler becomes aware of the facts to which the complaint relates, but in any case within one year after the advice or information provided.
4. The traveler has the right to appeal to the competent court.
5. Any right of claim expires one year after the end of the reserved service or if the trip did not take place, one year after the original departure date. The right of claim also expires if the complaint relates to the services provided by Angling Escapes | De Vissende Hollander one year after these services.
Participation in events organized by De Vissende Hollander is at all times entirely at your own risk.
Angling Escapes | De Vissende Hollander will take over their obligations towards the traveler, imposed in a binding advice by the Magistrate, unless they have submitted the binding advice to the Court for review within two months of the date of the advice. For the application of this guarantee, it is required that the traveler makes a written appeal to this.
Article 09 Cancellation
We advise all customers to take out travel and cancellation insurance with an insurer.
1. The client may make changes free of charge up to 7 working days after placing the reservation. Unless it is a last minute reservation.
2. In case of cancellation after 7 days from placing the reservation, 50% of the reservation will be withheld.
3. In case of cancellation of the reservation within 8 weeks before arrival, 100% of the payment will be withheld.
4. For a last minute reservation, 1 month before the arrival date, there is no refund of the travel sum.
Article 10 Online Calendar
Despite working with a fully automated booking system where the owner also immediately receives a confirmation email of your booking, some water owners unfortunately still work with a less automated system.
And despite the fact that we, as soon as we receive bookings from the owner himself, immediately process them in our automatic agenda, there may be some delay in the processing process. That is why we always check your booking together with the owner to prevent errors.
In the worst case that there is still a case of the fact that the owner himself had just received a booking that had not yet been processed in our system, we will contact you as soon as possible. Then we will see together whether you can perhaps move the date, or we can offer you another location or otherwise we will immediately refund your deposit to your account.
Article 11 Publication of Photos and Information
The locations we work with have given us the right to collect photos that they post on social media. When you have given the owner the right to publish, you have also given us the right to advertise with it. If there is a problem with the publication of a photo, please contact us.
