Article 01 Definitions
1. The assignment:
The assignment concerns the agreement between the traveler and Angling Escapes S.L. whereby Angling Escapes commits to providing the traveler with online services in the field of fishing and related travel, in the broadest sense of the word.
2. Angling Escapes S.L
The party who, in the exercise of their business, advises, informs and mediates in the conclusion of agreements in the field of travel.
3. Service provider:
The carrier, accommodation provider, Angling Escapes S.L. and/or other service providers in the field of travel, in the broadest sense of the word, with whom the traveler enters into an agreement and who, in compliance with the applicable conditions, is responsible for the execution of the service.
4. Traveler:
a. The client (applicant), or
b. The person on whose behalf Angling Escapes S.L. has performed services that have been accepted by the client.
Article 02 The Assignment in General
The content of the assignment may include informing and advising the traveler online, as well as reserving the services desired by the traveler, if possible.
2. The client is bound to the agreement with Angling Escapes S.L. and the service provider after the assignment has been issued, regardless of whether a confirmation is provided directly. If a fee is owed for a service of Angling Escapes S.L. itself, Angling Escapes S.L. will announce this in advance.
3. The (order) confirmation will generally be sent to the client by email within approximately seven working days, in which case this confirmation serves as proof of the agreement described in the confirmation.
4. The client has the opportunity to submit a written objection within three working days after receiving the assignment confirmation, if they believe that the agreement is not correctly represented on the confirmation. In the absence thereof, the confirmation serves as proof of the existence and content of the agreement. This does not affect the possibility for the client to provide counter-evidence. Even if the order confirmation is sent by Angling Escapes S.L. later than mentioned above, the client can submit a written objection within three working days of receipt.
5. The client is fully liable to both Angling Escapes S.L. and the service provider for the obligations arising from the services provided by Angling Escapes S.L. The other travelers are liable for their part.
Article 03 The Reservation Assignment
1. The client will provide Angling Escapes S.L. with the information concerning himself and the (possible) other traveler(s) required for concluding the agreement and its execution, in consultation.
2. The prices of reserved services can be changed in accordance with the conditions of Angling Escapes S.L. These changes will be communicated as soon as possible and will be charged accordingly.
3. Any cancellations of, or changes to, the provided assignment(s) can only take place on working days and only at the request of the client. If a cancellation takes place at the request of the client, or changes are made to the already made reservations, the associated costs will be charged. In addition to the cancellation or modification costs charged by the service provider, these may also include the costs that Angling Escapes S.L. has to incur to effect the cancellation or modification.
4. All communications from Angling Escapes S.L. or the service provider will be addressed exclusively to the client.
Article 04 Payments
1. The amounts due must be paid to Angling Escapes S.L. within the period specified by Angling Escapes S.L. Angling Escapes S.L. is authorized, if necessary, to collect the amounts due in the name and for the account of the relevant service provider(s).
2. Angling Escapes S.L. will require a deposit equal to 50% of the total agreed travel sum when the order(s) are placed (unless otherwise agreed).
3. The remainder of the amount due must be received by Angling Escapes S.L. no later than the date stated in the confirmation or invoice. In case of any discrepancies between confirmation and invoice, the confirmation applies.
4. If payment is not made or not made on time, the traveler is in default, Angling Escapes S.L. then has the right to charge the costs as referred to in article 3.3 or to set them off against the deposit(s) received.
5. Any refunds are made exclusively to the client.
Article 05 Liability
1. Angling Escapes S.L. will observe the care of a good contractor in its activities.
2. If Angling Escapes S.L. provides services (including advice/information) that lead to the creation of a package travel agreement to which the conditions apply, only these conditions apply, also with regard to the liability of Angling Escapes S.L.. In that case, the responsibility for handling complaints about the services provided by Angling Escapes S.L. rests with Angling Escapes S.L..
3. The conditions also apply if Angling Escapes S.L. must be regarded as Angling Escapes S.L. under Spanish law, for example if it sells a package tour from a foreign provider.
4. Without prejudice to the foregoing, Angling Escapes S.L. accepts no liability for actions and/or omissions of the service provider(s) involved, nor for the accuracy of the information provided by these service provider(s). Angling Escapes S.L. is not responsible for photos, folders and other information material, insofar as these have been published under the responsibility of third parties.
5. Insofar as Angling Escapes S.L. itself is imputably failing and the traveler suffers damage as a result (including damage due to lost travel enjoyment), the liability of is limited to a maximum of 10% of the invoiced services.
6. Liability for damage against which the traveler is insured (e.g., through travel and/or cancellation insurance or health insurance), as well as liability for damage that the traveler suffers in the context of practicing a profession or business (including damage from missing connections or not arriving at the destination on time), are excluded.
7. Angling Escapes S.L. is not responsible for any promises made by its personnel and/or third parties, which demonstrably deviate from the conditions stated in these terms and conditions or in the conditions of the responsible service provider, unless such promises are subsequently confirmed in writing.
8. The exclusions and limitations of liability included in this article also apply to the benefit of the personnel of Angling Escapes S.L. and/or the third parties engaged by it.
Article 06 Documents
1. The traveler who is in default owes the statutory interest unless the conditions of the relevant service provider prescribe a higher interest rate.
2. Furthermore, the traveler is obliged to reimburse extrajudicial costs incurred by Angling Escapes S.L. for the collection of the claim. This amount equals 15% of the claimed amount with a minimum of €60, unless this amount is unreasonable considering the collection activities.
Article 07 Interest and Collection Costs
1. The traveler who is in default owes the statutory interest unless the conditions of the relevant service provider prescribe a higher interest rate.
2. Furthermore, the traveler is obliged to reimburse extrajudicial costs incurred by Angling Escapes S.L. for the collection of the claim. This amount equals 15% of the claimed amount with a minimum of €60, unless this amount is unreasonable considering the collection activities.
Article 08 Disputes
1. All disputes between Angling Escapes S.L. and the traveler are subject to Spanish law. Only a Spanish court has jurisdiction to hear these disputes.
2. Complaints about reservations.
Complaints about a reservation made by Angling Escapes S.L. can be submitted in writing to Angling Escapes S.L. up to three days after the end of the reserved service or, if the trip has not taken place, up to one month after the original departure date stated in the travel documents.
3. Complaints about advice and information.
Complaints about advice and information provided by Angling Escapes S.L. must be submitted in writing and with reasons to Angling Escapes S.L. within one month after the traveler becomes aware of the facts to which the complaint relates, but in any case within one year after the advice or information provided.
4. The traveler has the right to appeal to the competent court.
5. Any right of claim expires one year after the end of the reserved service or if the trip did not take place, one year after the original departure date. The right to claim also lapses if the complaint relates to the services provided by Angling Escapes S.L. one year after these services.
At all times, participation in a trip organized by Angling Escapes S.L. is entirely at your own risk.
Angling Escapes S.L. will take over its obligations towards the traveler, in a binding advice imposed by the District Court, unless it has submitted the binding advice to the Court for review within two months after the date of the advice. For the application of this guarantee, it is required that the traveler makes a written appeal to this.
Article 09 Cancellation
We advise all customers to take out travel and cancellation insurance with an insurer.
1. The client may make changes free of charge up to 7 working days after placing the reservation. Unless it is a last minute reservation.
2. In case of cancellation after 7 days from placing the reservation, 50% of the reservation will be withheld.
3. In case of cancellation of the reservation within 8 weeks before arrival, 100% of the payment will be withheld.
4. For a last minute reservation, 1 month before the arrival date, there is no refund of the travel sum.
Article 10 Online Calendar
Despite working with a fully automated booking system where the owner also immediately receives a confirmation email of your booking, some water owners unfortunately still work with a less automated system.
And despite the fact that we, as soon as we receive bookings from the owner himself, immediately process them in our automatic agenda, there may be some delay in the processing process. That is why we always check your booking together with the owner to prevent errors.
In the worst case that there is still a case of the fact that the owner himself had just received a booking that had not yet been processed in our system, we will contact you as soon as possible. Then we will see together whether you can perhaps move the date, or we can offer you another location or otherwise we will immediately refund your deposit to your account.
Article 11 Publication of Photos and Information
The locations we work with have given us the right to collect photos that they post on social media. When you have given the owner the right to publish, you have also given us the right to advertise with it. If there is a problem with the publication of a photo, please contact us.
Customer portal:
Access to the customer portal
The customer can access the customer portal using personal login details. These login details are strictly personal and may not be shared with third parties. The customer is responsible for the confidential use of his or her login details.
Use and responsibility
The customer is responsible for all activities that take place through the customer portal using his or her account. The customer must use the portal in accordance with these terms and conditions and applicable laws and regulations.
Accuracy of data
The customer is responsible for keeping the data provided through the customer portal correct, complete, and up to date. Angling Escapes is not liable for damage resulting from incorrect or incomplete information provided by the customer.
Availability
Angling Escapes strives for the highest possible availability of the customer portal, but cannot guarantee uninterrupted access. Angling Escapes is entitled to temporarily take the customer portal out of service for maintenance, updates, or other technical reasons.
Security
Angling Escapes takes appropriate technical and organizational measures to secure the customer portal. However, Angling Escapes is not liable for damage resulting from unauthorized access, unless there is intent or gross negligence.
Misuse
In case of suspected misuse, unauthorized use, or a security incident, the customer must report this immediately. Angling Escapes reserves the right to temporarily or permanently block access to the customer portal in case of misuse.
Changes and termination
Angling Escapes reserves the right to (partially) change or terminate the customer portal. If this significantly affects the service, the customer will be informed in a timely manner.
Liability
To the extent permitted by law, Angling Escapes is not liable for indirect damage resulting from the use or inability to use the customer portal.
Closing the account
The customer can close his or her account in the Angling Escapes customer portal at any time, provided the conditions below are met.
Outstanding obligations
Closing the account is not possible as long as:
- There is an outstanding payment; and/or
- There is a reservation or other agreement linked to the account that has not yet taken place or been fully completed.
Aftercare period after reservations
After a reservation, booking, or other obligation has fully taken place, the account remains active for a period of six (6) months. This allows room for any communication, refunds, guarantees, or other aftercare. The account can only be closed after this period has expired.
Consequences of closure
After the account is closed, access to the customer portal will expire. Angling Escapes processes and stores personal data in accordance with applicable laws and regulations and the applicable privacy policy.

When making a reservation, your email address will be added to our newsletter system. If you do not wish to receive this, you can easily unsubscribe at the bottom of the newsletter. You can also send us an email to info@anglingescapes.nl and indicate that you do not agree with this. Then we will unsubscribe you immediately.
